The sticks and stones of evidence: The German Federal Court of Justice on 'prima facie' evidence and other practical challenges for claimants and defendants

The German Federal Supreme Court (BGH) has caused a lot of sensation with its latest ruling on antitrust damages law of 11 December 2018. For it has rejected the hitherto established case law on prima facie evidence. The Higher Regional Court of Dusseldorf (OLG Düsseldorf) has now openly positioned itself against the BGH in this matter with its decision of 23 January 2019. At first glance, much seems to be unclear. In this webinar, we will classify this current case law for you and point out the consequences for claimants and defendants. In addition, we will look at further hurdles to evidence and provide you with a practical guidance of evidence from a litigator's perspective.
