The EU´s Digital Services Act package – What you need to know

On 15 December 2020, the EU Commission has published its draft proposals for the Digital Services Act (DSA) and Digital Markets Act (DMA). The DSA, alongside the DMA, is part of the EU Commission’s digital strategy aiming to reinforce the Digital Single Market and to realize the full potential of eCommerce. The two main goals of the Commission are to create a safer digital space in which the fundamental rights of all users of digital services are protected and to establish a level playing field to foster innovation, growth, and competitiveness, both in the European Single Market and globally.

The Digital Services Act provide a staggered set of obligations and liability rules for intermediaries (such as internet access providers, domain name registrars, search engines), hosting services, online platforms (such as social media platforms, app stores and online marketplaces), and finally, special rules for very large online platforms. The Digital Markets Act enables the European Commission to designate certain online platforms as ‘gatekeepers’ and to impose an extensive list of antitrust-inspired obligations on those platforms.
