Samantha Joshua has extensive experience in corporate, commercial and litigation matters. Her practice focusses on assisting domestic and international clients in respect of restructuring of commercial operations, whether arising from financial distress or otherwise and matters incidental thereto.
She has extensive experience in advising clients on their compliance with corporate law, mining laws and regulations and aspects of health and safety compliance. In addition, Samantha has experience in representing clients in a variety of commercial disputes.
Samantha’s commercial experience includes representing and advising international clients on the complex regulatory compliance framework in respect of the disposal of manufacturing and processing operations.
Representative experience
Assisting an international client in the disposal of its processing operations and advising in respect of environmental liability and exposure as part of the transaction.
Representing and advising the joint business rescue practitioners in the ongoing separation of processing and mining operations in order to unlock commercial value in the disposal of those assets.
Representing and advising clients in respect of disputes involving the development of shaft operations.
Successfully representing an international client in respect of the delinquency of a director for breach of fiduciary duties.
Representing the business rescue practitioner in the disposal of mining operations and advising in respect of the transaction involving disputes with minority shareholders.
Assisting with and drafting appeals in terms of the Minerals and Petroleum Resources Development Act.
