EU´s Digital Services Act package - What you need to know

On 15 December 2020, the EU Commission published its draft proposals for the Digital Services Act (DSA) and Digital Markets Act (DMA). The DSA, alongside the DMA, is part of the EU Commission’s digital strategy aiming to reinforce the Digital Single Market and to realize the full potential of eCommerce.

The Digital Services Act provides a staggered set of obligations and liability rules for intermediaries (such as online marketplaces, search engines, social media sites, and other platform operators), hosting services, online platforms, and special rules for very large online platforms. The Digital Markets Act enables the European Commission to designate certain online platforms as ‘gatekeepers’ and to impose an extensive list of antitrust-inspired obligations on those platforms.
