For two decades, Allen Pegg has concentrated his practice in complex litigation, arbitration, and appellate work, and he now leads the Miami office’s litigation team.

Allen’s clients rely on his judgment and broad range of experience to help them resolve their most difficult matters.  Whether involving disputes arising from healthcare or financial services, business torts, class action defense, or corporate governance issues, clients turn to Allen as a trusted advisor. Among his specialties, Allen regularly represents some of the nation’s largest health insurers in suits challenging out-of-network payments, claims processing, other payment practices, ERISA, fraud, and various manners of alleged contract claims.

Regardless of the forum, Allen approaches each case with a unique perspective on how best to tailor his strategy to accomplish his client's particular goals. He has first-chaired numerous jury trials, bench trials, and arbitral hearings, and has briefed and argued dozens of appeals in state and federal courts.

Allen is regularly regarded as a top practitioner in commercial litigation by various publications, including Best Lawyers in America, Florida Super Lawyers, and the South Florida Legal Guide.

Allen is also continuously giving back to the community. He regularly handles an array of pro bono matters, and for more than a dozen years, he was a member of the federal appellate list for Criminal Justice Act appointments.

In 2010, the Chief Judge of the Southern District of Florida appointed Allen to the Southern District of Florida's Local Rules Committee, on which Allen has served ever since.

Following law school, Allen served as a judicial clerk to the Honorable Donald M. Middlebrooks, U.S. District Court for the Southern District of Florida, and to the Honorable Rosemary Barkett, U.S. Court of Appeals for the Eleventh Circuit.

Representative experience

Representing Medicaid Managed Care Organizations in statewide class action challenging interest calculations and securing denial of class certification after evidentiary hearing.

 

Representing a health insurer in multiple federal actions brought by various out-of-network medical providers seeking additional reimbursement, securing dismissals with prejudice in each.

 

Lead counsel for large defense group in action challenging payment practices for emergency fixed-wing air ambulance services, securing complete win on jurisdictional and federal preemption grounds.

 

Representing a health insurer in multiple AAA arbitrations brought by in-network hospital systems alleging various breaches of hospital network agreements.

Representing CEO & owner of highly consumer products brand in a variety of complex disputes in multiple forums, including first-chairing various trials, culminating in successful two-week jury trial.

First-chaired jury trial in prosecution of claims stemming from collateralized business loan gone sour, resulting in unanimous verdict in client’s favor.

First-chaired jury trial in defense of claims arising from large real estate dispute, resulting in complete defense verdict and no appeal being taken.

Representation of financial institution in defense of putative nationwide class actions alleging improper collection of international transaction fees and, in a separate action, violation of the TCPA.

 

Successful defense of nationwide loan servicer in federal putative class action challenging collection of post-acceleration late fees.

Representing accounting firm in federal action alleging US$175m in aiding and abetting liability brought by unsecured lender arising from historic Ponzi scheme.

Representation of regulated public utility in five consolidated putative shareholder class actions challenging terms of large proposed merger.
