Episode 1 – Regulating AI – the European Approach and the APAC Perspective

Our multi-jurisdictional speakers discussed how the different regions such as Mainland China, Hong Kong, Singapore and Australia are reacting to both the challenges and opportunities presented by AI, how some have decided to “plough their furrow” while others have drawn on the European Union Artificial Intelligence Act which some may view as aiming to set the “gold standard” in AI governance. They drew on their global and regional experience to share their insights on how to address regulatory challenges and approaches to AI governance.

Episode 2 – AI liability demystified – legal complexities and accountability

AI technology raises difficult questions about the scope of potential civil liability, including AI-driven privacy violations, discrimination, failure to spot compliance issues, accidents, and security breaches. If a loss or some other harm has been caused by AI that uses machine learning to make decisions on its own, general liability principles such as foreseeability, may be difficult to apply. Our speakers explored how these issues are tackled in the APAC region and shared their recent experience from Europe and what impact the newly established EU regulations will have on specific industry sectors including health, transport, industrial and others.

The session considered:

• General civil liability including civil and tortious liability
• Breach of duty and discriminatory practices
• Burden of proof, standard of care, attributing fault
• Allocating risk and commercial considerations
• Liability scenarios and possible outcomes

Episode 3 – AI – credibility, copyright and deepfakes

Data can be manipulated in ways that can deceive and mislead. The rapid development of AI has left some crucial questions unanswered. Our speakers discussed some of the key legal developments around AI in the intellectual property space and how this is leading to more litigation and regulation globally.

During this session, we addressed some key questions and issues including:

• Is AI-generated content capable of satisfying the test of “originality” to attract copyright protection?
• How much human input is required during the generation to benefit from copyright protection?
• Large Learning Modules – what protections should be brought in against unlimited data scraping?
• Deepfakes – how to protect yourself and your brand from unwanted interference.
