Alicia Paller helps clients across industry sectors navigate privacy, data breach, tort, and false and deceptive advertising lawsuits. She advocates for clients in a wide range of complex commercial litigation matters, with a particular focus on class actions and multijurisdictional litigation.

Alicia also advises clients immediately following a ransomware attack or data breach. Working closely with legal counsel, security officers, and forensic experts, Alicia develops early strategies to fend off litigation through settlement negotiations or motions practice. Alicia has experience managing affirmative and defensive discovery, preparing fact and expert witnesses, drafting dispositive and non-dispositive briefs, and speaking in court. Alicia also has experience analyzing and negotiating contracts, responding to State AG investigative demands, responding to Office for Civil Rights inquiries relating to HIPAA Privacy Rule and Security Rule obligations, advising clients on incident response issues related to forensic investigations and privilege, and conducting small- and large-scale internal investigations for health care, technology, and medical device companies. 

Alicia maintains an active pro bono practice that includes regularly appearing in civil and criminal court on behalf of survivors of violent crimes. Alicia and her team received Network for Victim Recovery of DC’s “Firm Voice Award” for their tireless work on behalf of survivors. Alicia also co-authored the Brief for Amici Curiae American Historical Association and Organization of American Historians in Support of Respondents (Jackson Women’s Health Org., et al.) in Dobbs v. Jackson Women’s Health Org., et al.

Representative experience

Obtained early dismissal on the pleadings in privacy action against academic health care institution.

Defended leading technology/app company in class actions arising from a cyberattack, resulting in wins enforcing arbitration agreements.

Defended internet advertising company accused of violating consumer privacy under common law and state statutes.

Assisted health care clients in responding to cybersecurity incidents and privacy- and cybersecurity-related HHS investigations.
