David Michaeli is a litigator focused on preventing complex business disputes where possible and resolving them efficiently where necessary. In and out of the courtroom, David emphasizes commercial knowledge, strategic thinking and creativity to help clients achieve their business objectives.
David's practice, which has earned him recognition by a prominent trade publication as a Rising Star in the areas of business and appellate litigation, includes transactional advice and dispute resolution. David represents clients in many industries, including aviation, manufacturing, technology, and financial services. He has particular experience litigating and advising on cross-border claims. David also regularly represents clients in 28 U.S.C. § 1782 actions, which he has won in twelve U.S. jurisdictions. David has recovered billions in cash and non-cash compensation on behalf of his clients, and he has also successfully defended billions of dollars in claims.
David has published dozens of articles on legal and industry issues, including articles on M&A law, the aviation industry, and the Foreign Sovereign Immunities Act. In addition, David maintains a robust pro bono practice and is active in the legal community. David currently represents two death-sentenced defendants in criminal cases and he has previously represented several domestic violence victims and asylum applicants. David also regularly counsels charitable organizations. David formerly served as secretary of the New York City Bar Association's Committee on State Courts of Superior Jurisdiction, and as a member of that committee's Legislative Subcommittee.
Representative experience
Represented the buyers of more than 835 Boeing 737 MAX aircraft, valued at more than $80 billion at list prices, in claims arising from the grounding of the 737 MAX
Won dismissal of a US$100m action brought against a German financial services client in the U.S. District Court for the District of Nevada on forum non conveniens grounds
Represented one of the world's largest private corporations in fraud claims against the sellers of a technology business
Advised buyers and sellers on dozens of transactions valued from tens of millions to billions of dollars on dispute prevention, dispute resolution, enforceability and other issues
Represented an energy company in claims against two vendors relating to explosions during hydraulic fracturing operations
