Updates on brand protection in China – review of 2021 and forward looking

The year 2021 was a fruitful year for China trademark protection. With the 2019 Amended Trademark Law has been implementing for 2 years, there have been some substantial developments and improvements in trademark prosecution and protection: China authorities have taken multi actions in curbing bad faith filing and infringement; damage awards in trademark cases continue to rise; China Trademark Office (the “CNIPA”) has taken various measures to speed up the trademark prosecution, and etc. All these developments have brought opportunities but also challenges to brand holders.
