For nearly twenty years, Olaf Gärtner has led complex international and domestic disputes for his clients, with special emphasis on leading clients in the tech sector. As co-head of our global corporate litigation practice, he has extensive experience in all kinds of litigation, mediation and arbitration.
The focus of his practice lies on advising national and international companies in leading edge tech and corporate disputes and all issues of directors' and officers' liability. Olaf handles disputes between shareholders, litigation between shareholders and the company, disputes in joint venture structures as well as M&A disputes - often in combination with complex leading edge tech questions and issues of company valuation. In addition, Olaf advises and represents clients in all other kinds of civil and financial disputes, with a particular focus on mass litigation involving the most advanced legal tech solutions.
Clients and competitors praise him as a "level-headed litigator," "unflappable," and "cunning litigator." His extensive experience, tactical overview and strategic approach are also reflected in leading legal directories. For example, Olaf has been highlighted for years in the JUVE Handbook as a "frequently recommended lawyer" for corporate litigation and is listed by Legal 500 Germany for his expertise in litigation. Advising a leading manufacturer of high performance materials in a dispute with a former JV partner after the failure of the JV with damages claims amounting to a two-digit mill. Euros amount.
Representing Media-Saturn-Holding GmbH in a shareholder dispute between the former Metro AG (now Ceconomy AG) and the founding shareholders of the MediaMarkt stores.
Representing an Asian High Tech Conglomerate in an ICC arbitration with respect to a post-M&A dispute following the acquisition of a business unit from a DAX30 company.
Representing a leading producer of specialty metal products in appraisal proceedings against about 80 former shareholders after a squeeze-out of minority shareholders.
Advising a leading IT services company in a 50/50 joint venture and a related shareholder dispute.
Advising a leading online retailer with regard to allegations re its online pricing and competition principles, incl. various EU-wide cases re management liability for alleged breaches of duties, etc.
Supporting a global client in the financial services space with regard to its investment in various unsecured notes in the course of international restructuring efforts of the debtor
